Introduction

We value the trust you place in us and recognize the importance of information privacy. This Privacy Policy describes how Pacific Mall(s) collect, use, share, protect or otherwise process your personal data through Pacific mall application. Please note we do not offer any service under this Platform outside India and your personal data will primarily be stored and processed in India. By visiting this Platform, providing your information or availing any service offered on the Platform, you expressly agree to be bound by the terms and conditions of this Privacy Policy, and agree to be governed by the laws of India including but not limited to the laws applicable to data protection and privacy. If you do not agree please do not use or access our Platform.

Applicability

1. This Privacy Policy applies exclusively to this Application with immediate effect and by visiting our application you agree to be bound by this Privacy Policy.
2. This Privacy Policy is binding upon you on each occasion when you visit the application including while (i) registering yourself on application, (ii) undertaking any activity on the application.
3. This Privacy Policy does not apply to entities which are not managed, owned or controlled by Pacific Malls or to the people who are not engaged, employed or managed by Pacific Malls.

• We collect your personal data relating to your identity, demographics when you use our Platform, services or otherwise interact with us during the course of our relationship and related information provided from time to time. Some of the information that we may collect includes- sign-up/registering or using our Platform such as name, date of birth, address, telephone/mobile number, email ID, gender. For example: when you (a) send Pacific Mall(s) any feedback on any mall or brand; (b) receive any updates on special offers that are offered by the brands; (d) inquire about Pacific Mall’s brands & services; (f) create/register an online-account with Pacific Malls or subsequently update any information so provided; (g) conduct online surveys; etc.
• Our web-servers will collect non-personally identifiable information such as IP address, browser versions, number of visits, time-spent on application, etc.
• Our primary goal in doing so is to provide you a safe, efficient, smooth, and customised experience. This allows us to provide services and features that most likely meet your needs, and to customise our Platform to make your experience safer and easier. In general, you can browse the Platform without telling us who you are or revealing any personal data about yourself. Once you give us your personal data, you are not anonymous to us.
• Please note that you are under no compulsion to provide your personal/non-personal information and any information provided by you is with your full consent, own volition and desire to provide such information.

If Pacific Malls is involved in a merger, acquisition or asset sale, we will continue to ensure the confidentiality of any personal information and give affected users notice before personal information is transferred or becomes subject to a different privacy policy.

The Information collected on the Platform shall be stored and processed in India and shall be governed by the applicable laws of India (including data protection and privacy laws).

We provide all users with the opportunity to opt-out of receiving non-essential (promotional, marketing-related) communications from us after setting up an account. If you do not wish to receive promotional communications from us, then please unsubscribe by clicking on the unsubscribe link in the email. All Users will be notified by email prior to any actions taken.

Data Deletion and Retention

You have an option to delete your account by visiting your Profile and Settings on your mobile application, this action would result in you losing all information related to your account. You can also write to us at the contact information provided below to assist you with these requests. By deleting your account, you will not be able to access your order history, your preferences, details of any pending orders, exchanges, return or refunds, coupons or benefits from loyalty programs.

Once the account is deleted, you will lose access to the account, however you may access the Platform again you would need to register as a new user on our Platform.

We retain your personal data information for a period no longer than is required for the purpose for which it was collected or as required under any applicable law. However, we may retain data related to you if we believe it may be necessary to prevent fraud or future abuse; to enable Pacific mall to exercise its legal rights and/or defend against legal claims; or for other legitimate purposes. We may continue to retain your data in anonymised form for analytical and research purposes.

Change/Modification/Amendment to Privacy Policy

This Privacy Policy is subject to changes, modifications and amendments and we reserve the right to make to changes, modifications and amendments based on business, legal or regulatory requirements. The Privacy Policy, as and when changed, modified and amended, shall be updated on the Platforms. Governing Law

The terms of this Privacy Policy shall be governed and construed in accordance with the laws of India. Any dispute regarding or arising out of this Privacy Policy shall be subject to the exclusive jurisdiction of the courts situated in India.
