Introduction

We value the trust you place in us and recognise the importance of information privacy. This Privacy Policy describes how Pacific Malls collects, uses, shares, protects or otherwise processes your personal data through the Pacific Mall application. Please note we do not offer any service under this Platform outside India, and your personal data will primarily be stored and processed in India. By visiting this Platform, providing your information or availing any service offered on the Platform, you expressly agree to be bound by the terms and conditions of this Privacy Policy, and agree to be governed by the laws of India, including but not limited to the laws applicable to data protection and privacy. If you do not agree, please do not use or access our Platform.

Applicability

1. This Privacy Policy applies exclusively to this Application with immediate effect, and by visiting our application you agree to be bound by this Privacy Policy.
2. This Privacy Policy is binding upon you on each occasion when you visit the application, including while (i) registering yourself on the application, and (ii) undertaking any activity on the application.
3. This Privacy Policy does not apply to entities which are not managed, owned or controlled by Pacific Malls, or to people who are not engaged, employed or managed by Pacific Malls.
4. Our site may, from time to time, contain links to and from the websites of our partner networks, advertisers and affiliates. If you follow a link to any of these websites, please note that these websites have their own privacy policies, and that we do not accept any responsibility or liability for these policies. Please check these policies before you submit any personal data to these websites.

Collection of Information

• We collect your personal data relating to your identity and demographics when you use our Platform, services or otherwise interact with us during the course of our relationship, and related information provided from time to time. Some of the information that we may collect includes details provided at sign-up or when registering or using our Platform, such as name, date of birth, address, telephone/mobile number, email ID and gender. For example, when you (a) send Pacific Malls any feedback on any mall or brand; (b) receive any updates on special offers that are offered by the brands; (c) inquire about Pacific Malls’ brands and services; (d) create or register an online account with Pacific Malls, or subsequently update any information so provided; or (e) take part in online surveys.
• Our web servers will collect non-personally identifiable information such as IP address, browser version and number of visits and time spent on the application.
• Our primary goal in doing so is to provide you with a safe, efficient, smooth and customised experience. This allows us to provide services and features that most likely meet your needs, and to customise our Platform to make your experience safer and easier. In general, you can browse the Platform without telling us who you are or revealing any personal data about yourself. Once you give us your personal data, you are not anonymous to us.
• Please note that you are under no compulsion to provide your personal or non-personal information, and any information provided by you is with your full consent and own volition.
• By accessing the application or sharing information on the application, you permit Pacific Malls to use your information, including personal or sensitive personal data or information, as provided or as may be provided to Pacific Malls, and stored by Pacific Malls in electronic form in connection with your use of the application.
• For the avoidance of doubt, Pacific Malls is under no obligation to verify the source of your personal information or sensitive personal data or information, and shall not be responsible for the authenticity of the information provided by you. You may choose to withdraw this consent (unsubscribe) by writing to Pacific Malls at loyalty@pacificindia.in.
• Cookies and similar technologies: We use various technologies to collect and store information when you use the Pacific Malls service, and this may include using cookies or similar technologies to identify your browser or device.

Uses of Information Collected

We use the information we collect from all of our services to provide, maintain, protect and improve them, to develop new ones, and to protect Pacific Malls and our users. We also use this information to offer you tailored content, such as more relevant search results.

When you contact Pacific Malls, we keep a record of your communication to help solve any issues you might be facing. We may use your email address to inform you about our services, such as letting you know about upcoming changes or improvements.

If Pacific Malls is involved in a merger, acquisition or asset sale, we will continue to ensure the confidentiality of any personal information, and will give affected users notice before personal information is transferred or becomes subject to a different privacy policy.

Storage

Information collected on the Platform shall be stored and processed in India and shall be governed by the applicable laws of India, including data protection and privacy laws.

Opt-Out Policy

We provide all users with the opportunity to opt out of receiving non-essential (promotional or marketing-related) communications from us after setting up an account. We reserve the right to limit membership based on the availability of contact information. All users will be notified by email prior to any such actions being taken.

Data Deletion and Retention

You have the option to delete your account by visiting your profile and settings on the mobile application; this action will result in you losing all information related to your account. You can also write to us at the contact information provided below to assist with these requests. By deleting your account, you will not be able to access your order history, preferences, details of any pending orders, exchanges, returns or refunds, or coupons or benefits from loyalty programmes.

Once the account is deleted, you will lose access to it; however, to access the Platform again, you would need to register as a new user.

We retain your personal data for a period no longer than is required for the purpose for which it was collected, or as required under applicable law. However, we may retain data related to you if we believe it necessary to prevent fraud or future abuse, to enable Pacific Malls to exercise its legal rights and/or defend against legal claims, or for other legitimate purposes. We may continue to retain your data in anonymised form for analytical and research purposes.

Change, Modification and Amendment to Privacy Policy

This Privacy Policy is subject to change, modification and amendment, and we reserve the right to make changes, modifications and amendments based on business, legal or regulatory requirements. The Privacy Policy, as and when changed, modified or amended, shall be updated on the Platform. While we make all reasonable efforts to communicate any significant changes to this Privacy Policy to you on a best-effort basis, we encourage you to review this Privacy Policy whenever you visit our Platform to understand how your information is used. Governing Law

The terms of this Privacy Policy shall be governed and construed in accordance with the laws of India. Any dispute regarding or arising out of this Privacy Policy shall be subject to the exclusive jurisdiction of the courts situated in India.

We are committed to protecting the privacy of children. In accordance with Indian law, we do not knowingly collect personal data from children under the age of 18. This application is open to individuals above 18 years of age.
